“Insteadofdomesticabusers,murderers andsexoffendersusingtheircashtoobtain release,judgescanfinallyholddangerousindividualspriortotrial,”LakeCountyState’s AttorneyEricRinehartsaidinaprepared statement.
RinehartandCookCountycounterpart KimFoxxweretheonlystate’sattorneysof the102inIllinoiswhovocallysupportedthe eliminationofmoneybond.Manyothers wereplaintiffsinthelawsuitseekingtoblock it.
Underthelaw,nonviolentoffendersno longerwillbedetainedbecausetheylackbail money,Rinehartsaid,addingthatthemoney-basedsystemdisproportionallyjailsBlack andbrowndefendants.

Theeliminationofcashbail,whichgoes intoeffectSept.18,doesnotmeantheendof pretrialdetention,Rinehartnoted.

SPRINGFIELD –AlandmarkcriminaljusticereformthateliminatescashbailinIllinoisisconstitutional,thestate’sSupremeCourtruledTuesday, pavingthewayforthechangetotakeeffectSept.18.
The5-2decision–handeddownonpartisanlines–meansthatanindividual’swealthwillnolongerplayaroleinwhethertheyareincarcerated whileawaitingtrial.Judgescanstillordersomeonetobedetainedastheyawaittrial,butthenewsystemwillbebasedonanoffender’slevelofriskof reoffendingorfleeingprosecution,ratherthantheirabilitytoaffordbail.
Thelistofoffensesforwhichajudgecanrevokepretrialreleasebecameapointofcontroversyinthetwoyearsfollowingthelaw’s2021passage untilitwasamendedinlate2022.Ultimately,lawmakerssettledonasystemthataimstodivertlower-levelnonviolentoffendersfrompretrialincarcerationwhilegivingjudgesgreaterauthoritytodetainindividualstheydeemdangerousoratriskoffleeingprosecution.
Agroupofstate’sattorneysandsheriffschallengedthelaw’sconstitutionalitybasedonthefactthattheIllinoisConstitutiondirectlyreferences “bail”intwosections,includingonethatstates,“allpersons”accusedofcrimes“shallbebailablebysufficientsureties.”
“TheIllinoisConstitutionof1970doesnotmandatethatmonetarybailistheonlymeanstoensurecriminaldefendantsappearfortrialsorthe onlymeanstoprotectthepublic,”themajoritywroteintheiropinion.“Ourconstitutioncreatesabalancebetweentheindividualrightsofdefendants andtheindividualrightsofcrimevictims.TheAct’spretrialreleaseprovisionssetforthprocedurescommensuratewiththatbalance.”
Thehighcourt’stwoRepublicanjusticesdissented.JusticeDavidOverstreet,ofthe5thDistrictinsouthernIllinois,wroteinhisdissentthathe believedtheGeneralAssembly’seliminationofcashbailwas“indirectviolation”oftheconstitution’sbillofrightsandanothersectionofthedocumentpertainingtocrimevictims’rights.
“Therefore,thiscourthasanabsoluteobligationtodeclarethepretrialreleaseprovisionsoftheActtobeinvalidandunenforceablenomatterhow beneficialtheabolishmentofmonetarybailmaybe,”Overstreetwrote,joinedbyJusticeLisaHolderWhite.
ThelawwasscheduledtotakeeffectonJan.1ofthisyear,butonDec.31thejusticesissuedanorderpostponingitsimplementationuntiltheyhad timetoruleonthecase.TheirTuesdayrulingnotedthattheirstaywillbeliftedin60days,onSept.18.
