MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Sylvester lives in what was previously a quiet neighbourhood in the leafy suburbs of a large town. His neighbour has let out his large house to 6 students and the comings and goings have greatly increased the noise level in the area. Two of the students have large 1200cc motorbikes and one is a boy racer. They have large rumbustious parties with lots of visitors on a Thursday night when Sylvester is kept awake long into the night and is cranky and useless at work the following day. He is wondering what he can do.
Research of the psychological and physiological effects of noise confirm the detrimental effect of noise on the human body resulting in irritability, depression and aggression and inter alia it can interfere with the learning ability of young children. Legislation in Ireland states that action can be taken when the noise is “so loud, so continuous, so repeated, of such duration or pitch or occurring at such times as to give reasonable cause for annoyance to a person in any premises in the neighbourhood or to any person lawfully using any public place”. There is no actual reference to any specific decibel level in the legislation. But it would be a good idea if one is affected by noise to get a handheld decibel level reader to establish where the decibel level is at. e.g. 35 decibels would be present in a rural nighttime setting with no wind whereas 100 decibels emanates from your disco or rock concert. Because if the definition in the legislation it is important to keep a noise diary and log all instances of the noise nuisance. The noise/nuisance diary will have date, time, type of noise and the impact on Sylvester and his invitees. Reports may also be made to the Gardai. With all neighbourhood disputes one should try diplomacy first approaching the students in a reasonable manner and asking them to tone it down. If this does not work, one can then approach the landlord. Keep a note of when these informal approaches were made and the response. If this does not work informally the next step is a letter setting out the issues and diary entries and requesting the noise nuisance to cease and desist. If this does not work one then has to go to court on a noise order application and the court may adjourn to allow mediation and if this does not work then the court can make orders in relation to limiting the noise, reducing the level of noise or stopping the noise completely. As this is a rented property situation one can also bring a case to the Residential Tenancies Board who have a two-stage process involving mediation in stage one and a public tribunal in stage two. There is a statutory obligation on tenants of a landlord not to engage in antisocial behaviour, and a landlord must take responsibility for the actions of the people he/she brings onto his/her property. Often a landlord once approached by neighbours about antisocial behaviour will take action as troublesome tenants will only embroil the landlord in much potential litigation. In relation to noise nuisance one can also bring a Civil Claim for Nuisance/Negligence against the neighbouring landlord for the noise nuisance and the impact on the person. At least for Sylvester there are a number of escalating remedies at his disposal to sort the problem out. The main thing is a keep a cool head and go through the processes and they will have a result but may take time. One may have to resort to the noise cancelling headphones in the meantime.

For years, Joan has dedicated her time and energy to improving lives in some of the world’s most disadvantaged regions. She praises Brighter Communities Worldwide for its focus on empowering local people to take charge of their own development.
“Communities must own projects if they are to bring about real change,” she says. “This happens through a strong base of local volunteers and staff.”

Minister for Justice Jim O’Callaghan confirmed in his Budget news conference today that his department’s section of the National Development Plan will include funding for Tralee courthouse.
Minister Foley said: “Budget 2026 contains €19.1 billion for new infrastructure. I am very pleased that my cabinet colleague, Minister for Justice Jim O’Callaghan, has confirmed that funding for Tralee courthouse is included in his capital plan. This is long awaited and I thank the Minister for visiting Tralee on foot of my invitation earlier in the year and delivering the necessary funding today.”

It is with enormous sadness that I have learned of the passing of Dick Henggeler. RIP. I wish to extend my very sincere sympathy to Eibhlín, Franz and family, the management and staff of The Rose Hotel, Tralee and Dick’s many, many good friends both in Ireland and in the United States.
Dick was the essence of graciousness, warmth and welcome and he successfully fostered this same spirit in his beloved Rose Hotel. To Dick, The Rose was always so much more than a hotel, he viewed it and those who worked in it as part of his extended family. On his visits he
presided over the hotel in his usual gentlemanly way with a warm smile and genuine welcome for everyone who crossed his path.
To our great good fortune Dick took enormous personal pride in Tralee town and was always available to generously support any community initiative or endeavour. A truly lovely man, it was always a pleasure to meet with him, chat with him and indeed learn from him.
We in Tralee are the lesser for Dick’s passing, but greater for having had the privilege of knowing him. His legacy is rich. May he rest in peace.
Seán Lyons, affectionately known as Kerry’s favourite Mayo man, will launch his memoirs, A Stranger Walking the Roads, at the Rose Hotel, Tralee, on November 8th at 6.30pm. A long-time resident of Tralee, Lyons takes readers on a remarkable journey from his small-town upbringing in the west of Ireland to adventures across Africa, Australia, America, and many other destinations before finally settling in Kerry.
The memoir is praised for its charm and humour, with author and columnist Martina Devlin noting
that it “brims with stories told with humour and warmth by a natural raconteur.” Lyons’ storytelling captures the essence of his travels and the people he met along the way, blending insight, wit, and heartfelt reflection.

With the economy facing an international headwind, the budget represents a more cautious approach. The much-muted VAT rate reduction to 9% for Food, Catering and hairdressing sector has been introduced but only from the 1st July 2026. For most businesses the increase in minimum wage will negate the benefit, but given itʼs a permanent change will be widely welcomed.
Aside from increases in social welfare and those who benefit from 9% VAT rate it offers little to individuals, farmers and other sectors who are largely ignored. The Budget focuses on job protection and international growth but is unlikely to prove popular in more rural communities.
The main discussion points in the budget were as follows:
• VAT Rate reduction from 13.5% to 9% from July 2026
• Minimum wage increased by 65c to €14.15 per hour
• No change to Main Personal Income Tax Rate or Tax Credits.
• Cigarettes increasing by 50c per pack
• Tax on Vapes 50c per millilitre
• Main Welfare payments increased by €10 per week
• No change to Main Personal Income Tax Rate or Tax Credits.
• USC rate of 2% rate band raised by €1,318 to €28,700
• Rent tax credit extended for three years.
• Mortgage Interest tax Credit Extended to 2026
• Main Welfare payments increased by €10 per week
• Christmas payments double for one week in December
• Child Benefit Increased by €16 over 12/ €8 under 12
• Domiciliary Care Allowance increased by €20 to €380 per month
• Weekly Fuel allowance increased by €5 to €38
• €5bn Capital Investment for delivering new homes
• VAT rate on the sale of completed apartments will reduce from 13.5% to 9% until December 2030.
• Derelict property Tax of 7% Market Value to be Introduced in 2027 replacing Derelict Site Levy
• Flat rate addition for VAT reduced from 5.1% to 4.5%

• Minimum wage increased by 65c to €14.15 per hour
• Pension Auto Enrolment to start January 1, 2026
• Extension of 9% reduced VAT rate for gas and electricity
Motoring
• The €10,000 Benefit-in-Kind (BIK) on the Original Market Value for electric cars will remain for 2026, reducing to €5,000 in 2027, €2,500 in 2028 and end in 2029.
• Carbon Tax for Petrol and Diesel will increase from €63.50 to €71.00 per tonne.
• Entrepreneurial Relief reformed and extended from €1 million to €1.5million
Education & Childcare
• Annual student contribution fee in third level will be permanently reduced by €500
• Back-to-school clothing and footwear allowance has been extended to 2 and 3-year-olds.
“Invest in our future while securing the jobs, prosperity and stability of today” .
– Minister Pascal Donoghue
“This budget included a lot of mentions about “targeting the most vulnerable” but when it comes to housing there was no targeting towards providing more low-cost or affordable housing for people who are struggling every day”
– Mike Allen, Focus Ireland Director of Advocacy
“Global economic uncertainty presented government with a trade off in Budget 2026, and it is clear today that VAT measures have trumped personal taxes in the need to protect employment.”

Kerry remained on top after the break, creating several chances through Finn Barrett and Ronan Teahan. Substitutes Daniel Okwute and Cian Brosnan added attacking threat, but Harps equalised in the 71st minute when Shaun Bradley bundled in a scrappy goal from a free kick, frustrating the visitors.
